ANGLERS INDEMNITY AND LIABILITY RELEASE

1. Acknowledgement of Risk
   The undersigned participant (“the Participant”) acknowledges that participation in any event organised by the Electronic Bass Anglers Sports Society (EBASS) may involve certain risks, including but not limited to personal injury, death, or damage to property. The Participant voluntarily assumes all such risks.


2. Release of Liability
   By signing this agreement, the Participant releases and discharges EBASS, its committee members, Mind Sports South Africa (MSSA) or any other federation or body EBASS is affiliated to, sponsors, agents, officials, employees, and volunteers (collectively “EBASS Parties”), from any and all liability, claims, damages, losses, costs, or expenses of whatsoever nature, arising out of or in connection with the Participant’s involvement in any EBASS event.


3. Covenant Not to Sue
   The Participant undertakes not to institute, and irrevocably waives the right to institute, any claim, action, or legal proceedings against EBASS Parties in respect of any injury, loss, or damage suffered by the Participant in connection with any EBASS event, save as provided under clause 2 above.


4. Indemnity
   The Participant hereby indemnifies and holds harmless the EBASS Parties from and against any and all claims, demands, damages, legal costs, and expenses that may be made against, or incurred by, EBASS Parties arising from:
   • (a) the Participant’s acts or omissions during an EBASS event; or
   • (b) claims made by third parties, insurers, heirs, or dependants of the Participant in respect of injury, loss, or damage sustained in connection with the Participant’s involvement in any EBASS event.


5. Insurance and Subrogation
   The Participant understands that by signing this agreement, they waive any rights that their insurers, heirs, or dependants may otherwise have to claim or institute proceedings against EBASS Parties by way of subrogation or otherwise, in respect of any amounts paid or payable on the Participant’s behalf.


6. Acknowledgement and Understanding
   By signing below, the Participant confirms that they:
   • (a) have read and fully understood this indemnity and liability release;
   • (b) voluntarily agree to be bound by its terms; and
   • (c) have also read and understood the EBASS tournament rules and regulations.
